Washington Consumer Health Data Privacy Policy

This Policy supplements the WISeRly Global Privacy Policy and applies only to "Consumer Health Data" as defined by the Washington My Health My Data Act (MHMDA).

1. Categories of Consumer Health Data We Collect

Clinical submission and PHI intake are currently disabled. For Washington residents interacting with current account, inquiry, billing, or synthetic demonstration services, WISeRly may collect:

  • Account and inquiry information: Information you provide when creating an account or contacting WISeRly.
  • Synthetic demonstration inputs: Fictitious case information entered in product demonstrations; real patient information is prohibited.
  • Technical identifiers: IP address, browser information, essential cookie identifiers, and timestamps used for operation and security.

2. Purpose of Collection and Use

We collect and use this data strictly as necessary to provide the services you request, including:

  • Operating the WISeRly AI compliance platform.
  • Ensuring the security and integrity of our technical safeguards.
  • Maintaining and improving current account and synthetic demonstration functions.

Note: We do not "sell" consumer health data for monetary or other valuable consideration.

3. Categories of Sources

We collect data directly from you (via web forms and tool interactions) and automatically through your browser or device interactions with our platform.

4. Sharing with Third Parties and Affiliates

We may share the categories of data listed above with:

  • Replit: Current application origin and development hosting.
  • DigitalOcean: The owner reports traffic routing and a BAA request in progress; the complete route and executed BAA are not verified in this project.
  • Stripe: Account, subscription, and payment processing; full payment-card numbers are not stored by WISeRly.
  • Ownership: WISeRly LLC is owned by the R.E. Salyer Family Revocable Living Trust.

5. Your Washington Privacy Rights

Under the MHMDA, you have the following rights:

  • Right to Access: Confirm if we are collecting, sharing, or selling your data.
  • Right to Withdraw Consent: Revoke any previous authorization for data collection.
  • Right to Deletion: Request the permanent deletion of your consumer health data.
  • Right to Appeal: If we deny your request, you may appeal by contacting legal@wiserly.com. If your appeal is unsuccessful, you may contact the appropriate Washington state enforcement authority.

6. How to Exercise Your Rights

To submit a request, please email compliance@wiserly.com with the subject line "Washington Privacy Request."

7. Independent Product Status

WISeRly is independent, not affiliated with or endorsed by CMS, and not an official WISeR participant. It provides preparation results rather than official determinations.
